buddy wants to get a class 3. what is he in for? can he buy like a class 1?

    You dont need a license to buy or sell NFA items.

    You need a license to deal in NFA items.

    See the NFA FAQ above for a start about what it takes to buy NFA items.

    If you want to deal in NFA items then you will need a business, a 01 FFL and pay your SOT.

    With more info of exactly what he wants to do we will be able to answer your question better. There are lots of things different things you can and can not do depending on what is is you want. State laws will also come in to play.

    So "what" is the correct question posted above.

    He needs to hold a Type 01 FFL to start and then pay the $500 SOT tax previously mentioned to become Class 3. A Class SOT is just another FFL dealer, except he is allowed to deal in certain National Firearms Act weapons (other than Destructive Devices). Becoming a Class 3 SOT is gong to mean convincing the BATFE that you can do some business, either retail sales (where allowed) or law enforcement sales. If your buddy already has an FFL and has done plenty of LE sales then the questions will be few. If he is applying for the FFL and looking for the SOT for the first time then there are likely to be some eye brows raised during his BATFE compliance interview before the FFL is issued.

    at this time he does not have a class01 license. he wants to get a supressor and maybe a full auto later. i told him good luck.

    You dont need an FFL to buy suppressors or a full auto, or any other NFA item. If you live in a state that allows them it takes a simple form fill out. If the item is in state and owned by a private person you dont even need to go though a dealer .

    Two National Firearms Act items with a total transfer tax of $400 (2 X $200). It will cost him at least $300 to get an FFL and and another $500 for Special Occupational Taxes, making the total at least $800, or twice as much. The hassles involved in simply owning a couple of NFA items: Few. The hassles involved in maintaining a dealer FFL and being Class 3: Many.
