C & R guns clarification

Hi, I've been researching this C7R gun category, everything I find refers to the 'C&R List', or I receive this general response..,

ie;"..any gun on the C & R list, and also any gun that you can prove is at least 50 years old.."

Problem is I haven't been able to find the 'C&R list' mentioned above, anyone have a link?

From what I gather if the gun is in its original state and 50 or more years old from todays date it will qualify as a curio & relic and thus able to ship to a type 03 license holder directly? And altho it seems this is a pretty broad question, what (general) modifications make it no longer in its original state?

Also another question, does or can the seller use the EZ check web link for C&R licensed collectors as well?

Thanks for any help, I'm trying to get all the facts before I list.

    Well here is all the C&R info right from the ATF's website, http://www.atf.gov/publications/firearms/curios-relics/

    No EZ check is not set up for C&R.


    Also the 50 year rule is for the date of the gun not the model number. Say you have 2 guns that are the same model and style. One is 49 years old and one is 51 years old. The 49 year old guns is NOT a C&R.

    The Curio & Relic list used to be available for viewing on the BATFE website, but the last time I looked, I could not find it.

    Any firearm that is 50-years of age (or older) is automatically a "C&R". The BATFE makes exceptions to the 50-year rule for rare, unusual, and "collectable" type firearms (e.g. Commemoratives, Special Edition, etc.), but they must be on the list to quailfy.

    Yes, you can legally ship a C&R eligible firearm directly to anyone with a Type 03 FFL... however there are some states with exceptions (mainly for handguns). It is important that the buyer is in compliance with his state laws.

    As for what "modifications" disqualify a firearm... that is a very large gray area, and it is not clearly defined. That said, general replacement of parts to make a firearm serviceable will not disqualify it.

    I believe (but am not 100% sure) that you can use the EZ Check for a Type 03 FFL.

    Any firearm over 50 years old and in it's original configuration is automatically classified as a Curio and Relic the day it reaches it'd 50th birth day. Firearms may also be ruled as C&R by the BATFE is they are under 50 years of age and are of special interest to collectors; like commemoratives. C&R FFL information is not accessible through teh EZ-Check system due to teh fact that most collectors use their home as their licensed premises and such private information is not the best thing to have floating around on the net.

    Just to clarify and hopefully not complicate, but if the C & R book lists a particular model with years of manufacture I think the gun is C & R eligible even if fewer than 50 years old, correct?

    To use your example, a Colt Python made in 1955 or 1956 is C & R eligible because it is greater than 50 years old - a Python made in 1976 is not C & R eligible.

    However, the Colt Officers Model Match is specifically listed with years of manufacture from 1953 to 1969, so where the model and years of manufacture are listed I believe that model gun is C & R eligible regardless of year of manufacture because it is specifically listed.

    The Winchester 94 pre 64 version and the Colt 2nd Generation SAA would also be in the same boat as they are specifically listed and have years of manufacture prior to and after 50 years past. A 1930s Wnchester 94 and a 1963 Winchester 94 would each be C & R eligible.

    Thanks for that link Nwcid, I just couldnt find it. I think I have it straight now as far as shipping and who I can & cant ship to as well as what & what not is shippable to whom. Never realized there was so much involved!

    Correct, example if you had a gun that was made in 2005 and the ATF ruled because of some special reason it was of collecting interest, it would be legal for C&R status. On the list are many individual guns with their s/n listed that are in this special status.
    A example is the Remington 150th year models made in 1966, they are not 50 yrs old but are deemed collectible and fall into C&R status. They are marked on the firearms as such

    Although there is no E-Z check for C&R 03 FFL's, you can verify a C&R license by calling the ATF licensing center toll-free at 1-866-662-2750.

    Above is to determine the buyers license as being valid. It is not for determining whether a particular firearm is valid, or not. Best, Joe
