Mossberg shotguns with pistol grip stock

A recent posting on this site quoted the ATF ruling that a shotgun would have to be designed to fire from the shoulder and pistol grip shotguns with no other stock would be classified as a pistol. The Mossberg 500 cruiser will come new in the box with a 18.5 inch barrel. A max length for a pistol barrel is 16 inches I believe. By owning this would you have to cut the barrel down to less than 16 inches to call it a pistol or since it was and is sold a shotgun do you have to place a buttstock on it.

    You have lots of problems here. If a smooth bore gun (shotgun) has less then an 18" or less then an 26" OAL then you either have a SBS or AOW both NFA items (see the NFA post above).

    Pistols can NOT be smooth bore, there is no such thing (in ATF definitions). Smooth bore pistol size guns are AOW's. The pistol griped shotgun is also not a pistol because a pistol is designed to be fired with one hand and these guns are not.

    You do not have to place a but stock on them. They are still considered a long gun but I am not sure how or what they are doing with them now, maybe one of our FFL's can answer that for us. It is true that it is no longer considered a shotgun by definition due to the lack of being shoulder fired.

    There is no maximum length for a pistol barrel, you can have a 20 inch barrel on a pistol if that is what you wish. These pistol grip shotguns are not being classified as pistols, they cannot be since they do not meet the definition of a pistol since they do not have a a rifled barrel. What has happened is that since they do not meet the definition of a shotgun (and they never have) the BATFE has ruled that these guns can not be sold as a long gun, which means that the buyer must be age 21 or above. If the barrel on a smooth bore firearm is below 18 inches then it is either a short barreled shotgun or an Any Other Weapon, but never a pistol.

    On the auction in question, you can leave it as pictured or place a but stock on it without a problem. If the barrel were shorter, then you might have some trouble. I hope all this helps.
