Legality of an M1D

It is legal to own a standard M1 rifle in NY under the AWB. Is the same true for the M1D sniper variant since it has a bayonet lug and has a flash hider attached? I have seen a few for sale at gun shows and shops in NY.

    Yes. The ban applies to so-called "assault weapons" manufactured after September, 1994.

    As I understand it - and I may be wrong because in CA the '94 AWB is dead, replaced by our own screwed up law - but the combo of FH and bayonet lug is the offending part in NY? Does the M1 Garand not having a detach magazine make any difference?

    If the bayonet lug and FH hider combination is an issue it's easy enough to remove one of the features without permanently altering the gun.

    The '92 AWB (that NY still adheres to) starts with:
    "A semi-auto rifle that has a detachable magazine"...

    If your rifle doesn't meet both of the qualifications of above paragraph, it's not a banned rifle.

    For instance:
    M1 Garand..good to go. No detachable magazine. Does not qualify. You can put any and all 'evil' features on the rifle.

    British enfield..good to go. No semi-auto action. Pistol grip/collapsible stock etc. is Okay also, because the Enfield is not one of the rifles that the ban focus on.

    Remember: it has to be both 1. Semi-auto, and 2. Uses a detachable magazine.

    Spider touched on another aspect: any rifle with 'evil' features mf'd prior to the ban is Okay to own/posess. NY grandfathers rifles made prior to the ban. (By made, I mean by SerNo lookup to determine just exactly when your particular rifle was made). Best again, Joe

    The flash hider should be a clamp on style.
