???Selling a Firearm to a Dealer???

I have a guestion for all. I was told (in no uncertian terms) that I (a private LEGAL person) sell any firearm, to a dealer or ANY person, for a PROFIT, I need a dealer FFL to sell. It is not legal to sell for profit, without a licence. ATF's rules? When did this happen??????

    You can't be engaged in the business.

    Buying something and then selling later for whatever price is fine.

    Now, if you are buying and immediately reselling then the Feds may get on to you...

    That is absolutely incorrect. Ask the person who told you to cite the federal statue or regulation that covers that. One or a few sales does not constitute "dealing in firearms."

    Sounds like somebody is trying to do a number on you. I've run into to this before myself. Some jerk has a FFL and figures that only gives him a right to sell guns. Best thing to do is just keep your mouth shut. You want to legally sell a small number of older collector type guns on one of the auctions or at a show, that's your business and no one elses. If somebody starts sticking their nose in your business, ignore them. Times are tough now for lots of folks, causing some guys to get pissed off about what they think are people stepping on their toes business wise.

    If making a profit was the sole indication of being a gun dealer than half of the gun shops in the country would not qualify as being dealers. Making money and engaging in the business, any business, have nothing at all to do with one another. You can spend 50 years in the business, never make a dime and still be a gun dealer.

    As the folks have said- this is BS. If you are ENGAGED IN THE BUSINESS of buying and selling guns, then you DO need a FFL. That means devoting time and attention to MAKING A LIVELIHOOD. The term "profit" is not in the Federal standards.

    When people tell you something like this that sounds like complete BS I simply ask them to prove it.

    If they are right, seldom, then it is easy to prove. If they are wrong it can not be proved. Anyone who does not want to prove it knows they are wrong, or dont want to find out they are wrong. Dont mess with either of those kind of people.

    profit has nothing to do with it,Buying with the intention of reselling it right away may be considered being in business. There was a deal on here awhile back about some guys that were buying online then taking what they sold to fleamarkets and such to resale them .they were doing this as a side business to make money..that was a no no and they got spanked but if you just want to sell someting you own,or bought something your not happy with,,by all means make all the profit you can from it
