C&R Question
I've got a m-92 win. up for auction here (#46161756) that has been copletely rebuilt but to all original spec's. it this still c&r transferable. A potential bidder wants to know. thanks.

I just finished filling out my C&R renewal and was surprised to see question #8 ask my if I have, or planned to do any internet sales. It then went on to ask which site(s) I planned to use. I don't remember that last time, any idea as to when that appeared? 0 -
As long as your Type 03 FFL remains valid any Curio and Relic firearms that you obtain from any source, which includes retail purchases, must be entered into your A&D book. Only those firearms which you had before getting your FFL do not have to be entered. Bert H and I had disagreed about this but he was in fact correct. 0 -

The basis for this, and we might as well take another look at it, is in the way that the regulations are drawn up for FFL holders. In the case of FFL dealers (I use myself as an example): The presumption exists that every firearm I have on premises is in fact a part of my business inventory but he BATFE realizes that if I wanted to obtain a firearm for myself (personal use) I am not going to run down the nearest gun shop and have them order it for me, I'll use my own license to buy it! I buy the gun using my own dealer FFL and when the gun arrives I enter it into my A&D book as usual but then I sign it out to myself (no background check needed and no 4473). At this point it is my personal firearm but it must be identified as such and I typically use a hang tag that reads: PERSONAL FIREARM NOT FOR SALE and then keep it 100% away from my business inventory! There is no mechanism in the regulation that allows this for collectors since it is considered automatic that any Curio and Relic firearm obtained by a Type 03 FFL (a Collector of Curios and Relics) from any source (including retail purchases from FFL dealers) is in fact going into his/her collection. Since a collector cannot buy C&R firearms for the purposes of resale then there is no other valid reason for a collector to obtain a C&R firearm except to add to his collection. 0 -
