    Thats a good example Neal. Some people like our friend here, just think they are going to play poker with the BATFE, and the BATFE will show their hand before the game is over.

    It was a very important point with the ADULT signature required. The carrier won't know that, unless you declare it. That is one of those area's that the BATFE wrote on the back side of the ticket, in ultra fine print, but it is there...You don't need to declare it...but you need an adult signature at the recieving end.

    I have never been one who cares for jail food, or to be bubba's bride...but some will never learn, untill they get to that point.

    In EITHER case, weather required, or not required to notify the carrier of the contents, Federal Law requires an ADULT signature. That is something most carrier's do not give away for free. So the shipper, must notify the carrier that an ADULT signature is required on the recieving end. So what else, besides a firearm, do the carrier's have to collect ADULT signatures for?

    Nope. This case does NOT support your argument. You have merely presented a case that SUPPORTS my statements. [:D] He broke federal law by not informing the contract carrier. Yes! In THIS case he WAS required to inform the carrier because the recipient WAS NOT an FFL. That definitely IS a violation of federal law. He shipped it INTERSTATE to a NON-FFL recipient. READ THE LAW. The point I have been trying to make is that if he had sent it to an FFL he would have been covered by the exception in the federal law. Most of my shipping and the shipping of others on GB are enroute to a FFL holder and are exempted BY FEDERAL LAW from being disclosed to the carrier. [:D] We have enough BS restrictions imposed on us by laws without folks inventing imaginary ones that go even further. [;)]

    The defendant isn't the brightest bulb in the chandelier. He engaged in strawman purchases more than once (probably because he wasn't a Texas resident or he had some other disqualifier) AND he attempted to ship interstate to someone other than himself without sending it to an FFL, and he had it in a car, in DC, without a permit, and was shooting out the window. LOL Besides, about the only legal way to ship to an out of state non-FFL that I can think of is when you ship it to yourself in another state and in that case, you DO have to disclose the contents to the carrier. He probably addressed it to his friend, instead of to himself c/o his friend (just guessing) which is also a violation. Again, OBEY THE LAW, but don't make additional restrictions. [:D]

    andrewsw16 has it right. I have a letter from the BATF dated 5/1/02 in which the writer states that "it is not mandatory to notify the shipper of the package contents" if it is going to a FFL. However, I also have a letter from the BATF dated 4/5/00 in which the writer states that Federal law requires that the carrier be notified. (Both were signed with the same name!) Nevertheless, the BATF persists in misstating the law in its FAQ:
    quote:A nonlicensee may ship a firearm by a common or contract carrier to a resident of his or her own State or to a licensee in any State. A common or contract carrier must be used to ship a handgun. In addition, Federal law requires that the carrier be notified that the shipment contains a firearm and prohibits common or contract carriers from requiring or causing any label to be placed on any package indicating that it contains a firearm.

    I pointed this out in my letter that sought clarification on the 4/5/00 letter. Eight years later the BATF still has not changed its web site.

    That's a good question, and one that attorneys could keep in the courts for years! [:D]
