    I don't know about this guy, but some folks aren't happy sending modern handguns to 03's. There are a few States and municipalities who won't allow C & R's to directly receive modern handguns. They (the C & R's) have to have it shipped to a 01 Federal Firearms Dealer.

    I won't ship a handgun to a Type 03 FFL because I can't use USPS.

    All of which may be valid reasons not to ship to you.

    But, he indicated he wouldn't ship to you because it is not a C&R. He may choose to believe proof from the ATF website, or not; it's his right to refuse to ship to you, whether from ignorance or personal choice.

    Maybe I'll submit a suggestion to GB management: there is a place on listings for "FFL required?". This item could give you 3 choices-1. FFL required
    2. FFL or C&R required
    3. Not required

    At least, this would force sellers to think before they post their ads.

    EDIT: No Mike, the "rules" are in DMM 601.11.1 & USPS Pub 52 432. They say "dealer", &, as David says, a C&R licensee in not a dealer.

    That shouldn't make any difference. Buyer typically pays the shipping and you could have a dealer ship it direct to him if you didn't want to go to UPS or Fedex. Saves the buyer the transfer fees and improves the sale chances and probably price as there would be more bidders possibly

    Maybe you have a FedEx and a UPS customer counter in your neighborhood but I don't. FedEx used to be 20 miles away but that installation closed. I have no idea where the nearest one is now. UPS is 35 miles away and the counter is open exactly 90 minutes a day. I ship USPS or you can come get it.

    A Type 03 license is a license to collect, not a "dealer" license. I have a Type 01 license, so I am a "dealer." As such, I can ship USPS to another "dealer," but not to a "collector." I think it's silly, but they aren't my rules, just stuff I have to deal with.

    Dave, I could be wrong (1st time? [;)])........but, as I read the 'rules' a 01 ffl CAN ship (usps) a handgun to a 03 ffl.

    Time for a trip to the eye doctor or lay off the sauce when your reading the ATF regs, MIKE. That's one of the major bi**hs of the C & R guys. I've got so tired about them belly aching about this on the boards, I don't even read the posts anymore.

    Come on guys, we have done this one dozens of times on the board. Collectors cannot mail handguns or receive them in the mail, even if shipped from a dealer.
    Postal Regs allow for this:
    11.1.5 Manufacturers and Dealers

    Handguns may also be mailed between licensed manufacturers of firearms and licensed dealers of firearms in customary trade shipments, or for repairing or replacing parts.


    Collectors are not manufacturers, they are not dealers and by BATFE statute cannot be involved in the customary trade in firearms (trade meaning being in business and not swapping goods). To engage in the trade would be engaging in the business and a Type 01 Dealer FFL is needed.
