New York gun laws & gunbroker sellers
Hi ,I live in upstate NY and I get surprised by the amount of ignorant un-informed GB sellers here concerning NY laws. I see parts kits and mags for auction that i would like to purchase but most sellers state "NO sales to new york". When i email them or bid-win and then get told they wont send to ny i try to explain to them, to no avail, that there are 2 gun laws, 1 for New York City and 1 for upstate. NYC and its 5 burroughs including long island ban high cap mags but in upstate NY we have gun shows that sell high cap and drum mags plus parts kits and complete semi's just at much higher gun prices then GB. I have read and re-read NY state gun laws online and here it states that the only magazines that are illegal are " "Large capacity ammunition feeding device"
means a magazine, belt, drum, feed strip,
or similar device, manufactured after September
thirteenth, nineteen hundred ninety-four, that
has a capacity of, or that can be readily restored
or converted to accept, more than ten rounds of
ammunition; provided, however, that such term
does not include an attached tubular device designed
to accept, and capable of operating only
with, .22 caliber rimfire ammunition.""" meaning that anything made before september 13 1994 is legal. That is taken directly from the website . Take the time to read 16 pages of legaleese and you will see the breakdown.. Any ideas on how to educate the other sellers here?? It gets annoying being treated like second class citizen.
At least you are getting Second Class treatment, the folks from California tell us that they are not even treated that well.

I have the same situation. That's one of the problems with both the city and the state being named "New York". Some people assume it's the same place!
All you can do is refer them to New York STATE law but, if they choose to ignore it, there's not much you can do and they've lost a sale through their ignorance.0 -
Maybe a trip to my shop in Hancock, NY will help you although I have very few pre ban mags in stock at this time . 0 -
Well...I hear you, but it all started when people refused to ship stuff to CA. Then all the distributors, and sellers, jumped on board to NY, NJ, MA, and a couple others. It almost certainly will never change, untill the legislators figure out that a gun, bayonet lug, bayonet, pistol grip, collapsable stock, or high cap feeding device, has never jumped into action and killed anyone, let alone masses. At least not without a mentally derranged idiot(which they will not circumvent the HIPPA laws for), behind it.
Some things like magazines, which savvy sellers realize they can make an extra margin for true pre-bans, the buyer can find.

Ref: the NYS penal code when using the word 'illegal'. The item in blue, below needs clarification.
I had a gunshop owner tell me that the word illegal in the NYS penal code refers to useage, not posession.
He went on to tell me that it would be perfectly legal for him to sell post-ban hi-capacity magazines...and the onus is on the 'end user' (buyer) when, and if he makes the attempt to use them!
Anyone care to either support, or refute the item in blue, above? If above is true, then the buyer (end user) needs to be really careful about purchasing the magazines that are laying inside the retailers' showcases, unless irrefutable evidence of pre-ban manufacture is available. where in Hancock is your shop?, I was there about 16 years ago to explore some abandoned musoleum on a mountain and see some caves. 0 -
I have spent many childhood days on that mountain top. My buddies house sits at the foot of the hill the masouleum is on . Shop sits at 95 East Front Street right smack in middle of town. 88th year of business you cant miss it. The shop is open 7 days a week although I live in Binghamton I cant be there every day..With my dad just passing away I am the only one who can sell guns so give me an email or heads up when you want to come so I can be there.
Givette : I agree the onus is on us to prove a magazine is preban and also on you the customer if you possess them. When in doubt I dont sell them.0
