Can a private individual sell and ship a handgun to another individual as long as he ships it to an FFL holder for transfer at the other end?

Yes. The FFL will also want a copy of your driver's license for their books. You can't use the USPS though. You have to use either FedEx or UPS and in order to do that, you need a copy of the FFL (at least that's what they've always asked of me) and it has to be overnight (their policies) which can get really expensive. Sometimes it's cheaper to get an FFL to mail for you and pay them a small fee requesting they use the USPS because they are FAR cheaper. quote:Originally posted by 5mmgunguy

Yes. A nonlicensee can transfer a firearm to a resident of his own state (state & local law permitting), or to an FFL in any state.
The FFL must be willing to accept a firearm from a nonlicensee. Most will want a photocopy of your drivers license, a reasonable request.
You can only ship UPS or Fedex Next Day Air or Airsaver, Adult Signature Required. You must ship from a company customer counter (hub), not a packing store.

EDIT: I shipped a handgun to NY; the dealer had no problem giving me a copy of his FFL & accepting it. I have heard this "FFL-to-FFL only" requirement about NY before; it's not in ATF P5300.5. If someone would kindly cite the reference for me, I'd feel better about repeating it.0 -

XP100, Please tell who where handgun to NY must go FFL to FFL can be found in writing. I am not doubting it just would like to know where to read it.
Added: Does this mean that unlicensed person can't take a pistol to a ffl dealer and sell it to him in NY?0 -
It is in the NYS law not the BATF regulations. I will see if I can locate the NY law. 0 -

If the selling person does not have a NY state pistol permit, they cannot even posses a pistol or revolver in NY state. Let alone, taking it to a dealer and selling it. The only ones allowed to sell handguns in NY are dealers who have an FFL, and NYS dealer's license, or a NY state pistol permit holder.

The executor of an Estate with proper paperwork can sell estate guns to an FFL with a NY dealer license. 0
