SBR Transfer from an individual
I have bought a SBR from a person that resides in another state. I have asked my local dealer to facilitate the transfer. He hold a class III dealer license and is pays the SOT. The firearm is currently on a form 4.
My dealer had the seller fill out a form 3 for the transfer from the seller to my dealer. ATF rejected it and wants a form 4.
My says that he has always transfered SBRs on form 3s from out of state.
If the seller fills out the form 4 with the dealer as the party it is being transfered to, does it need the CLEO certification? What happens to the finger prints and photograph? Certainly me dealer is not going to submit those.
I spent quite a bit of time on the ATF FAQ site and could not find answers to these questions. I am certain that one or more of you have done these transfers before.

Form 3 is used for the tax free transfer of NFA firearms between licenses only, if the firearm is coming from a non licensee then the dealer needs to use a Form 4 to receive the firearm. Form 4 has an area (line 5) for the dealer to list his FFL number and also specifically exempts SOTs from the applicant certification and LEO sign off (on the reverse of the form).
I have no idea of the history or the circumstances but if your dealer had NFA firearms transfered to him from non licensees using a form 3 then this was done out of policy and I would not advertise it to the BATFE!0 -
Yes, it is not the application forms the ATF wants, it's the $200. This will be a $400 transaction total. The tax to get it transferred to your state, and the tax to get it transferred to you. 0 -

Form 4 from your dealer to you $200
Your dealer is wrong and ignorant of NFA laws.
