Selling a C&R gun from France

My question: Can an individual living in France,sell a gun via gunbroker to an individual in the states?

    Unless it violates French law he certainly can. The issue should be whether or not the buyer in the USA can accept the gun but since we don't know what type of gun it is; rifle, shotgun, pistol, military surplus (those are a big problem) other than it is a Curio and Relic, we are at a standstill until more of the secret is revealed.

    Only licensed importers may bring in surplus military firearms classified as Curio and Relics. If you want the rifle you'll have to secure the services of an Type 08 FFL Importer who is registered with The Department of State. Figure $300+ for the service plus the cost of shipping and storage in a bonded warehouse until import markings can be applied to the receiver and the rifle released by US Customs.

    what about the collapsable stock? can that be taken off and sold without the barrel/receiver without going through that process. He says the barrel has been demilled. Im not sure what he means by that.

    The problem is that all of the parts on an M1 carbine fall under The US Munitions Import List; CATAGORY I including firearms and all parts and all parts and component parts for firearms. The letter of the law is that you'd need an import permit from the Department Of State, Office Of Defence Trade Controls. The DEMIL barrel on the carbine in no way changes it's status as a firearm for the purposes of importation into the United States. It probably makes it exempt from French firearms law, but has no effect here where the rifle is still considered to be a functional firearm.

    one other thing, if the barrel has been demilled( whatever that involves) that would probably knock it out of C&R status. Guns must be in their or very close to original configuration to be C&R eligable.

    That is a good point and one that I had not considered.

    I should also point out that there are a number of special restrictions in place on the re importation of former US property marked firearms. In order to be allowed into the USA the exact origin of the rifle in question must be established; like how it ended up in the hands of a French civilian. If provenance cannot be established it cannot be imported or if it is then as soon as it hits the USA it once again belongs to Uncle Sam and the US taxpayers, the folks who paid for it in the first place!
