destructive device ?

have a friend that has an A1M1 bazooka made by the stanley tool co. about 1944 and I am going to have a dealer in DD's sell it for him.
if it stays in the US I know it has to go to another DD dealer but if it sells overseas what all is involved in shipping it to a person in a euro country that has the proper credentials? does their paperwork have to be approved by our ATF if its leaving the US?
the bazooka has not been dewatted and is in very nice condition. it was a vet bring back.

    The BATFE has nothing to do with exports, those fall under the preview of the Department of State and there is a special branch that deals with arms exports. DEWAT or not, for export purposes this is still a CATAGORY II Artillery Projector (a catch-all section for rocket launchers, firearms over fifty caliber, recoilless rifles, flame throwers, ect.). While it is possible for an individual to obtain an export permit from the Dept. of State to export sporting firearms overseas, as a private person you'll never get an export permit for any item in the US Munitions List. This is the stuff for the big boys; exporters who are on file with the State Department and registered under the Arms Export Control Act of 1976.

    As mentioned, the ATF's jurisdiction ends at our shoreline.

    The BATFE doesn't have the ability (or desire) to decide what kind of weapons LEAVE the USA, only which ones can ENTER or STAY here!

    Exporting military style hardware (including, but not limited to weapons) falls under regulation by the Dept of State, which as you can imagine, would not be too keen if American owned or manufactured military type weapons fell into the "wrong hands".

    In *theory* you could try to find someone who is already a licensed arms exporter to handle this for you, but in practice, I doubt any of the ones who do this would want to get involved. So I also think you're not going to find a way to legally export something like this.

    Being a bit cynical (but practical) here, it might help if you were politically connected. Happen to know a US Senator who owes you a favor?

    I'm going with the fact that a DD is one of the (five?) NFA classifications of weaponry..and that you know it's an NFA item.

    Now, the unknowns. Is a rocket launcher something that needed to be registered under the GCA amnesty? I would imagine so. Does your friend have the ATF form 4?

    If it's unregistered, the project can't move off 'GO', either domestically, or internationally, as I don't think a dealer will touch it. Best, Joe

    this is where I'm a bit miffed. how is it that I can own a LAW tube that has not been dewatted and something like the WWII bazooka doesn't fall under that catagory since it would be (more) dificult if not imposible to find a projectile for it than the law tube?

    as with most gov. regs concerning weapons it makes ABSOLUTELY NO sense. I mean you guys and I know that this is pretty much useless as a weapon. IF you had the means to turn out a projectile for it you'd build something a little more user friendly to fire it with.

    this is a beautiful piece of history which should be in a museum or appreciative collectors hands.

    I'll contact the state dept. and go from there. I'll keep you posted (if they'll let me have a laptop in the pen[8][:0]

    law tube is a one shot disposeable the bazooka can be reloaded and fired..cut a 2" hole in the side and you will be good to go

    suposedly one shot but we were crushing them in iraq to keep the enemy for re-using them I guess as ied's but if it'll fire once then you can make it to where it would fire again. maybe not fire the same rocket so you'd have to make your own but you'd have to do that with the bazooka as well.


    ain't no ammo available for that thing and if you did find a stash of ammo for it, it would be 70 years old and I wouldn't pull the trigger on that unless I had a few shots of shine and a crowd so I could at least say those most famous of last words. "hey ya'll, watch this" [xx(][:D]
