Stolen Gun Problem

I bid and won a gun on gunbroker. The gun was sent to a pawn shop which was my FFL. Before I could pick it up, the pawn shop called and said the gun was a stolen item and was being confinscated by the Sheriffs dept. I called the gunshop that had sent the gun and they had recieved the confinscation papers. They agreed to refund my money. That was two months ago. I have contacted them by phone and email with no response. The owner seemed nice and apologized but as of yet, no money. What should my next move be to recover my money?

    If it was me, I would send him an e-mail today, so it is in his in box bright and early tomorrow morning. In this e-mail I would state that if I had not recieved ALL of my money back, in the form of a cashiers check or money order by thursday, I would call the local law enforcement agency and report him for theft.

    I suggest that you read that thread & the follow-up discussions.

    Based on what happened in that case, I suggest that you immediately call your local ATF office & request an investigation. This is a federal case, & you need to document everything you can, & as quickly as possible.

    I would also send it Certified Mail, Return Receipt Requested. Use attention-getting buzzwords like "ATF", "Wire fraud" and "Selling stolen merchandise". Tell him the next letter goes to ATF and his District Attorney.

    Also, file a complaint with Gunbroker Support.

    Anything that leaves a trail emails that leave a copy in your sent file. Letters that with dates could be used as evidence if push comes to shove.

    Same deal from a couple months ago...pawn shop, stolen gun, failure to refund, threats to report to local police agency(s), ATF, etc., etc.

    If you paid via credit card you are ahead of the curve. Just contact your card's administrators (phone number on back of card) and demand that they reverse the charges off your card.....any charges at all that you paid these people with your card.

    Don't threaten these people. Go ahead tomorrow and start contacting everyone....EVERYONE. Send letters to police, ATF, etc. in the pawnshop's jurisdiction AND in your own jurisdiction. Contact the seller immdiately telling him you are having him investigated by his own state and local agencies and by the Federal BATFE and that you want all your money back, including shipping and expenses you are incurring dealing with his selling you a stolen weapon. Don't mess around with these people. Tell them you want the money immediately, by Certified Bank Check in an overnight mail envelope no later than seven days from the date of your Certified letter.

    As suggested, DO search out earlier recent Experts Forum topics and replies related to similar problems.

    While I'm glad that you have received some good advice, you should have read the Posting Guidelines first. These issues are handled by Admin on the Auction side and not in the realm of help from the forums. I guess the Moderators simply missed this one.
