Shipping air pistol to Hawaii via USPS

    The post office will not mail an air pistol for an American Commoner.
    When I sent my Walther LP2 off to the service center in Canada, it had to be mailed, UPS would not run it through Canadian Customs. But the post office would not accept it from me, I had to get a dealer to sign off on the paperwork.

    I do not think he needs an FFL to purchase or recieve in shipment by BATF rules, but the post office does not see it that way.

    The Gun Control Act of 1968 does not include airguns in the definition of what is covered by the law. Postal Service may have made up their own more restrictive rules.

    It seems that your between the proverbial rock and a hard place. If the PO won't ship it, use FedEx or UPS. As HA is a State last time I checked you shouldn't have the problems that HC faced. If all else fails refund the money and point out that you specifically noted in your ad that you wanted to transfer it through a FFL. As it's your personal property it's your call to dictate the terms of the transaction, not him.

    Just looked it up and the USPS does require an FFL for a friggin BB -Gun pistol.

    Nambu is correct- while it is not a firearm under the 1968 GCA, and does not need to be transferred thru a dealer (don't think it CAN be transferred thru a dealer- not a gun), the US Postal Service Domestic Mail Manual DOES consider it a firearm. cut & paste-

    431.1 Firearm
    A firearm is defined as any device (including a starter gun) that is designed, or may readily be converted, to expel a projectile by an explosion, a spring, or other mechanical action, or by air or gas pressure with sufficient force to be used as a weapon

    Does that mean that they do or do not allow me to ship it?

    Bwood- sorry, failed to make that clear. By US Postal Regs, handguns (and they DO define a pellet pistol as a handgun) can only be mailed between 01 Dealers and Manufacturers. I have an 03 C&R FFL, and I can't mail a handgun. So if you are not doing dealer to dealer, no, do not mail.

    Thank you for your help. I had emailed him with the total about an hour ago but I just emailed again and said forget it. UPS or I re-list. Anyone interested in a pistol? [:D]
