    I think I just found my answer on another site. Thanks.

    A regulation implementing Federal firearms laws, 27 CFR Section 478.11, defines C&R firearms as those which are of special interest to collectors by reason of some quality other than is associated with firearms intended for sporting use or as offensive or defensive weapons.

    To be recognized as C&R items, 478.11 specifies that firearms must fall within one of the following categories:

    Firearms which were manufactured at least 50 years prior to the current date, but not including replicas of such firearms;
    Firearms which are certified by the curator of a municipal, State, or Federal museum which exhibits firearms to be curios or relics of museum interest; and
    Any other firearms which derive a substantial part of their monetary value from the fact that they are novel, rare, bizarre, or because of their association with some historical figure, period, or event.
    Firearms automatically attain C&R status when they are 50 years old. Any firearm that is at least 50 years old, and in its original configuration, would qualify as a C&R firearm. It is not necessary for such firearms to be listed in ATF's C&R list. Therefore, ATF does not generally list firearms in the C&R publication by virtue of their age. However, if you wish for a classification of your particular firearm under categories (b) or (c) above and wish your item to be listed, you may submit the weapon to the Firearms Technology Branch (FTB) for a formal classification.

    If you read the regs, they require that it be any ONE of three conditions-
    1. On the published list OR
    2. The specific firearm (not the model) must be 50 yrs old or older OR
    3. The BATF has issued a finding (in writing) that a specific firearm is a C&R- usually given to request from a museum curator.

    C&R Firearms must be complete, and in original configuration. Example- a Mauser 98 with a synthetic stock- NO. Mauser 98 with a replacement stock of the same style that was used originally- YES.

    Some folks will argue the paragraph above. Argue with the ATF, not me- that is how the ATF sees it, and enforces it.

    EDIT- sorry, I type too slow! Bear in mind for age, that date the specific gun was made governs, not date the model was made. 50 yr old Marlin 39A- C&R. 49 yr old Marlin 39A- NOT C&R- but it will be next year.

    Just to clarify on the model issue. Where a model is specifically listed in the C & R book all years of production are eligible. For example, the Colt OMM from 1953 to 1969 covers all years of manufacture, not just the "over 50" produced. Same for the Colt SAA 2nd gen from 1956 to 1976, Winchester 88s and all Smith 53, etc.

    Why the Smith 58 is not listed is a mystery to me and being in CA a little frustrating. [:(]

    The original configuration thing is a nasty "grey" area that I hate. Some things are obvious, others not so much. Never heard of anyone getting busted over it but I would hate to be the first. The key to me with it is that it must be a legal C&R to transfer to a C&R holder. You are free to modify it after you get it. If the BATF questioned it, I made the modification in question after I bought it to the best of my recolection. At 67 that soemtimes gets fuzzy.
