florida gun law
I am taking the family soon to Florida for a vacation. I have a TN CCW. I know Florida and TN have no problems with CCW in our states. My question is, in TN. you can go to a restaurant that serves alcohol as long as you don't drink and you have a valid CCW. Can you do this in Florida? I will also be going to some spring training games while I am there. Do they search you or can you carry there too? I did a search and looked in the archives and could not find a question pertaining to this. Thanks for your help.

(12)(a)#8195;A license issued under this section does not authorize any person to openly carry a handgun or carry a concealed weapon or firearm into:
1.#8195;Any place of nuisance as defined in s. 823.05;
2.#8195;Any police, sheriff, or highway patrol station;
3.#8195;Any detention facility, prison, or jail;
4.#8195;Any courthouse;
5.#8195;Any courtroom, except that nothing in this section would preclude a judge from carrying a concealed weapon or determining who will carry a concealed weapon in his or her courtroom;
6.#8195;Any polling place;
7.#8195;Any meeting of the governing body of a county, public school district, municipality, or special district;
8.#8195;Any meeting of the Legislature or a committee thereof;
9.#8195;Any school, college, or professional athletic event not related to firearms;
10.#8195;Any elementary or secondary school facility or administration building;
11.#8195;Any career center;
12.#8195;Any portion of an establishment licensed to dispense alcoholic beverages for consumption on the premises, which portion of the establishment is primarily devoted to such purpose;
13.#8195;Any college or university facility unless the licensee is a registered student, employee, or faculty member of such college or university and the weapon is a stun gun or nonlethal electric weapon or device designed solely for defensive purposes and the weapon does not fire a dart or projectile;
14.#8195;The inside of the passenger terminal and sterile area of any airport, provided that no person shall be prohibited from carrying any legal firearm into the terminal, which firearm is encased for shipment for purposes of checking such firearm as baggage to be lawfully transported on any aircraft; or
15.#8195;Any place where the carrying of firearms is prohibited by federal law.
(b)#8195;A person licensed under this section shall not be prohibited from carrying or storing a firearm in a vehicle for lawful purposes.
(c)#8195;This section does not modify the terms or conditions of s. 790.251(7).
(d)#8195;Any person who knowingly and willfully violates any provision of this subsection commits a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.

Andrewsw16 that is the way the law is here in Tennessee. As long as it is a restaurant that serves alcohol you can legally carry concealed if you are not drinking. I am not sure how to interpret the law in Florida. Anyone know for sure? 0 -

Here in NV it doesn't matter. You can carry in any restaurant or bar. Guess what? There is no prohibition against drinking while carrying in NV either. They treat it like a DUI. You can drink but you have blood alcohol level limits. I guess you could call it PUI (packing under the influence). The ironic thing is that the limits are more liberal for guns than driving. 0.1 for PUI and 0.08 for DUI. Go figger. [;)] Still, legal or not, I wouldn't recommend it. Yes, I have had a glass of wine with my prime rib dinner, but that is the limit for me. I don't go bar hopping and pounding down shots while carrying. In fact, I don't go bar hopping at all. What you need to avoid is the PORTION of the restaurant where the major revenue is from alcohol. In most cases this would be the bar area.
For example, you go to a restaurant with a separate bar. DO NOT SIT IN THE BAR AREA, even if you do not intend to drink.
