Are Sellers Allowed to Do This? NO SELLER NAMED
This is a general question; I don't name the specific seller.
I was browsing the auction side and saw a seller with this in his listing:
Will ship to "brick-and-mortar" FFL dealers that keep normal business hours only! We DO NOT ship to "home based" FFL dealers. If you cannot find a store-front dealer to handle the transfer, please do not bid. If we receive an FFL and find that it is in a residential area, we will refuse to ship until provided with an FFL from a dealer in a non-residential area that keeps regular business hours.
I know support is still bogged down with work and I didn't want to ask them to look at the seller who had this if it's allowed. I don't see anything specific in GunBroker's rules that prohibit it, but it does seem to violate some level of "fairness" about transacting on GunBroker.
I'm guessing the seller, being a bricks-and-mortar store is feeling "undercut" by those without his overhead and this is his way of trying to prevent them from getting business. I don't see any other argument (legal or practical) that he could be using to justify this policy. Anyone have any ideas why he'd have this policy?

I am not clear on what, if any, position Gun Broker may have on that. I will say that while they urge dealers to make sales of legal firearms to places like California, GB will not insist that the dealers do business with a states that they do not wish to be involved with. At a higher level: There are a number of firearms wholesalers who will not ship to dealers who are home based and some wholesalers actually insist on receiving a photo of your commercial storefront before they will do business with you. 0 -
I can see some good reasons for this policy.
If the receiving kitchen table dealer (& his wife) are not home when the package is delivered, it may well be left on the door step. (Not all drivers notice the "Adult Signature Required" notation.) When the package is misdelivered on the other side of town, he gets a complaint "I never received it", which may well be the case.
Or, worse, a criminal steals it from the door step, & uses it in a crime. The shipping dealer then has to explain to the fellas with the bulges in the cheap suits.
"Store front" dealers can usually be counted on to be open during normal business hours.

I've actually seen more guns delivered to "the doorstep" of store front businesses than were left on my door step when I was a "home based" FFL(in business for 28 years).
Sellers can do business as they choose but I'd choose to do business with a seller a little less haughty.0 -
The seller can set his own rules and make internet purchases more difficult/expensive if he wants to. 0 -

I agree he's a bonehead. but sort of understand....I came home one day and found my 391 that I had sent to Beretta for warranty work leaning against my front gate. It was in a white box With the word BERETTA on the side of the box. The letters were 31/2 4 inches high. 0 -
No one has the right to be a bonehead. Just because he chooses to be one does not make it right. It's a good thing that we have Internet Forums to point out things like this, otherwise people will go around doing any damn thing they want. There should be more laws. 0 -
Everyone is allowed to be a bonehead, however it is up to the non-boneheads to decide whether or not we choose to do business with them.

So, who decides who is a bonehead and who is a non-bonehead?? Maybe this is something for the SCOTUS to take up?
toad67 - my post was sorta tongue-in-cheek. But only sorta. I visit the forums to see what is going on in the world of guns and shooting but, more and more, they are becoming a venue for guys to correct grammar, spelling, and even the intelligence of others. Why do we find it necessary to do such things? Slow day? Nothing good on TV?0 -
