Inheriting NFA Items

If you had the same executrix that my dad had there would be no worries about transfer. Prior to my dad's death he had a Mauser 9mm select fire carbine (similar to a broomhandle without the pistol grip), a select fire H&R Reising, an H&R Handy gun, and a few ite3ms such as a Remington 1100 matched set 410 &28. When it went to court all of those items were no where to be found.[:(]

In the past, inheritance hasn't been difficult.

"a lawful heir" is how the Law is written.

NOW, the ATF is only allowing F5 transfers for those NAMED in a Will.

Everything else, they are denying...and have for awhile...unless they fill out another F4 and pay the tax.

It's ridiculous, but that's how they're doing it.

as said, put them in trust. then, when the time comes, well in a sense the time never comes. its perpetual. it just keeps on rolling. the guns are owned by the trust, not the individual.

I think the OP was asking if his son could keep the weapons in a place other than his own. It's been quite a few years since I owned any NFA firearms but I seem to remember that I had to maintain them in my possession at all times. But, maybe the rules have changed since then, and maybe I'm missing the point of the OP.

Yes, my larger question was about storage. I can workout the transfer either w/ the new $200. & FFL help or w/o. I'm concerned whether my son (the new legal owner) can store these items in a safe where only he can open but a few blocks away from his home in my widow's home. I wish he would quit bringing up the thought of my death!

    Thanks guys,
