Question about transfer

(I know , I know, its a support thing and I have opened an issue...)

BUT... I buy a handgun from and individual... he shipped to my FFL dealer... My dealer said he cant transfer it to me b/c it was not shipped from another FFL

Is this the case???

    On a fed legal level? No... but the dealer must have something to enter as "received from" in his/her bound books. The FFL I use for transfers accepts a xerox (enlarged please to make the numbers more readable) of a drivers license.

    No offense to you meant in this comment. You should have worked this out with you FFL, before hand in this matter.

    To the best of my knowledge their is no legal requirement that a FFL only receive firearms transferred through another FFL, (referring to the non commie States/cities ). Some FFL's just won't do it. They don't want to be left holding the bag if there are any questions raised about the legal ownership of the firearm, I.E. If it's run through the NCIC and comes up hot, etc.


    EDIT #1, Don't mean to be peeing in your Wheaties, Neal. Years back when I was living in PHX. I wanted to have a pistol received by a local FFL. He informed me that PHX had a "pawnshop law" on the books. It required him to hold the pistol for 10 days after receiving it, and send the serial number etc to the cops. The cops would run the number. If it didn't come back hot, he could transfer the pistol to me after that 10 day hold.

    Not really a "support" issue.

    What we have here is a failure to communicate. The seller should have said in his listing, "Be sure that your FFL will accept delivery from a nonlicensee." You should have asked your FFL his conditions for accepting delivery.

    Now you have a Mexican stand-off, & the solution is: Work it out.

    Talk to your FFL & see if he is willing to process the transfer upon receipt of a the seller's driver license. That would be easy & legal, & expose him to no greater risk than any other transfer. But, if he is really bull headed & refuses to cooperate, you have no choice but to ask him to return the gun to the seller, & find another FFL who WILL accept from a nonlicensee.

    I believe that rufe-snow is incorrect. In most states, your FFL will run your purchase only through NICS, which checks the buyer's name & DOB. A stolen gun search through NCIC can only be done by a Law Enforcement Agency, &, even if that were done, you, not your FFL, would be the one holding the bag. No dealer has EVER EVER EVER had a problem transferring a gun received from a nonlicensee with a drivers license.

    I use two dealers: One guy charges $10 for a transfer but will only accept from another FFL. The other guy accepts from anybody (as per Fed. regs.) but he charges $30. Needless to say, I use the $10 guy whenever I can! The $10 guy also seems to get a kick out of the old, odd, or unusual stuff I collect. He also seems to be pretty well known and regarded in the industry. I stopped by one afternoon to see if he could order a certain new Ruger rifle for me. He had it for me the next morning! Not sure how he did that.

    your dealer is being a hard on. you can try to show him the regs and see if he'll come around. if he wont, then this is going to cost you money.

    theres no law that covers the receiving dealer sending it back to the seller. a gunsmith or manufacturer can return a gun directly the owner, but theres no section of code that covers this situation. if your dealer wont accept from an indivdual(legal in all but a few local jurisdictions), i can nearly guarantee he wont send it back to the seller.

    what you'll likely have to do is have the receiving ffl send to to the sellers ffl who will have to book it in from the seller and out to your ffl. thats one fee. then he'll ship it to your ffl, another fee. then your ffl will transfer it to you, another fee.

    you made the deal without doing the appropriate leg work, so walking away from it will earn you deserved bad feedback. this is an expensive solution, but it makes it right.

    You Need an NEW FFL Dealer that knows and Understands the Rules.
    Ask Him if He will let You have it for His Fee with-out puting it in His Book, If no then send it back to the seller, Then work with the seller.
    If you can get it from that FFL, then you can have another FFL log it through his book.

    If you are in NY state, there is a STATE law that a FFL may only recieve a handgun FTF, or from a FFL.

    I think it is resolved. the guy said that he placed a DL in the shipment and evidently failed to do so... He simply took a pic of his DL with his smart phone and emailed it to my guy and that should be that.
