Here we go again...NFA at 01 FFL Gunsmith

Once again, I've had an 01 FFL tell me that they cannot have an NFA device in their shop.

I know this information is false, because the LAST time this happened, and I asked for the info, I think it was Mr. Christian, who provided me with chapter and verse as to the fact that, per the current rules, an 01 FFL CAN work on NFA items, a copy of F1/F4 is usually requested.

Please cite me this info once again. Thanks! Yes, I've used the search function to no avail.

    yes, the weapons can be there, and they can work on them, but THE REGISTERED OWNER MUST BE PRESENT. ive had gander mountain thread quite a few of my toys. no big deal. i just waited in the store while they did it.

    Once again, it is that FFL's interpretation of the law, and what they are willing to, and not willing to do. No matter of how much you show them the law in black and white, will matter, as it s their policy, and their rules, as it is their A$$ that will be on the line.

    That said, you need to move on to another FFL, as it sounds like yo have had problems elsewhere before.

    Please take a look at the cartoon strip in your signature. As I have previously held FFL's, and work for them, with my gunsmith license from time to time, you need to realize, that everyone has limits. Seeing that you don't care for some of the "pansy FFL's", shop policies, that protect themselves, and you seem to know it all, why are you taking the weapon to a shop, instead of repairing it yourself? There is no law in he books, that says a owner can't work on his own stuff?

    Q: May a licensed gunsmith receive an NFA firearm for purposes of repair?

    Yes, for the sole purpose of repair and subsequent return to its owner. It is suggested that the owner obtain permission from ATF for the transfer by completing and mailing ATF Form 5 (5320.5) to the NFA Branch and receive approval prior to the delivery. The gunsmith should do the same prior to returning the firearm.

    Only the face of the form needs to be completed in each instance. ATF Forms 5 may be obtained from the Bureau of ATF, NFA Branch. ATF Form 5 is also available on the internet at www.atf.gov
    Form 5 is not required by any Law, but suggested for a paper trail while in the FFLs custody

    Lots of dis/mis/bad information when it comes to NFA and this issue pops up from time to time. I know some little pansy FFLs are afraid to have NFA stuff around, but blaming "the eeeevil ATF" for everything simply becomes tiresome after awhile.

    I am an FFL 07/C2...but sometimes folks have tools that you need or custom setups that you require the use of to fulfill a customer's needs. This FFL had already been corrected once on this matter, yet because some A-HOLE ATF employee told him otherwise, he keeps repeating INCORRECT information. He is, of course, well within his prerogatives to not accept ANY NFA for ANY reason...but blaming it on the ATF is BS, and easily disprovable BS to boot.

    Besides, HE'S losing money...not me. If anything, if I were a cutthroat POS that so many FFLs want to be, I'd celebrate his mis-informed-ness and chalk it up to "more money for me", but that's not how I operate. I want everyone to make money and address the needs and desires of customers. But above all, dissemination of the CORRECT info over INCORRECT info is paramount.

    Reminds me of a conversation I had years ago, wherein some old FART, who had been an FUDD-FFL for years, thought he knew everything and was telling this older couple that they didn't want to go into the SAR building at the show, because "all class 3" stuff required a 200 dollar tax PER YEAR, and unannounced ATF inspections approximately quarterly.

    I took great pleasure is setting this idiot straight...the older couple, despite not enjoying my profanity-laden diatribe, didn't look to this FUDD as the "great oracle" that he had apparently auto-anointed himself to be...I smiled the rest of the day.

    Truth was told. Accurate info was relayed. Just like how it's supposed to be.
