Sales and Shipping Question
Another stupid question for you guys.
Can you legally own a M1 Carbine in Colorado, Delaware, New Hampshire and Rhode Island?
Not sure of the laws or restrictions in those North Eastern states. and the new laws in Colorado.
Anyone know the laws there?
I ask because I will be listing an M1 Carbine.
Thanks for your input.
Mike

I'd never advise anyone to ask about State or local laws on an internet forum. Ask the buyer the usual questions and have him send an ID. I'm not sure why it would make any difference to you? You will ship the carbine to an FFL who then will transfer it to the buyer. If the buyer cannot legally own the carbine he will soon get the bad news that he should not have bought it in the first place. 0 -
I'm not concerned about an ID or state restrictions. I AM concerned that I have a valid FFL to ship TO.
It is legal to ship to a FFL in any state.0 -
GB has an FFL network that anyone can use. Also, there is a BATF&E site where you can verify an FFL. 0 -
CO doesn't restrict the M-1 carbine just magazine capacity - 15 rounds max. 0 -
The M1 Carbine being sent to New Hampshire is fine, including the magazine of any capacity. Sending it to a NH C & R FFL is fine too. 0 -
If it's more than 50 years old, you can either ship it to an FFL dealer or a C&R FFL holder in NY State with a 10-round-maximum magazine.
If a "newer" carbine, like a Universal, it needs to go to an FFL dealer only. However, it can not have a bayonet lug, folding stock or flash hider; Illegal in NY (not applicable to C&R items).0 -
Thank you guys for the input. Still questioning Delaware and Rhode Island.
Had them pull Colorado and New Hampshire from the restrictions list.
It will come with 2 15rd. GI issue magazine and an old GI issue magazine pouch.0 -
You're making this more difficult than it needs to be.
Federal law states that you can ship a firearm to any dealer in any state. You really don't need to worry about listing which of the 58 states you can't ship to prior to sale. Just include a boiler plate, "I will only ship firearms & mags to city/county/state where legal." That also covers you for shipping to a C&R.
If you are still concerned after the winning bid is received, you can then look it up in ATF P5300.5, or come back to us.
