    I have a friend who had his father pass away. He is selling his gun collection. One of the guns he has is a full auto from the 50's. He is not a class 3 dealer or has a class three license. I would like to purchase it, I can get a great deal on it. As soon as I can I will buy the class 3 stamp but how do we conduct this transaction legally?

    No. The handgun would have to be sent to an FFL dealer in Rhode Island.

    I agree with above.

    Quick answer is no.

    Face to face transactions between non-FFL licensees are limited to in-State residents only.

    The safest/smartest thing is to tell your "guy" that you'll send the gun to the FFL of his choice in RI, and then he can pick up the gun in person from the FFL.

    Yes, most FFLs charge a nominal transfer fee for this, and there will be some shipping costs, but if he's legally permitted to own the gun in RI, and he really wants it, he should have no objection to this. I'm guessing that's not the case.

    Non-FFL guys from Texas go to the big Tulsa gun show, and very often buy, sell, and trade handguns, face-to-face with other non-FFL guys from Oklahoma and other states. It isn't legal, but they do it.

    This fella (know it all) wanted to Western Union
    the money to me and have me ship the gun directly
    to him.
    Another red flag is I asked this fella " why would you
    pay me $450 for a gun that Buds gun shop sells for
    $298... Free shipping to FFl?

    I've got a negative gut feeling and that's why
    I asked you guys.

    99 times out of 100, your gut feeling is correct, and ignoring it..."I'll take a short cut and walk down that dark alley anyway"...Gets you into trouble.

    Shipping the pistol to Rhode Island would only compound the illegality of the sale.

    Or he was going to pay you with a fake money order. Your bank will cash it for you but weeks later it bounces back on them and then they get their money back from you.

    What others have said- unless you hold a FFL.


    Purchase ANY firearm in another state, must be from a dealer, and THEN must be a rifle or shotgun. Title 18, US Code, Section 922. Been that way since 1968.

    It shall be unlawful:
    (5) for any person (other than a licensed importer, licensed manufacturer, licensed dealer, or licensed collector) to transfer, sell, trade, give, transport, or deliver any firearm to any person (other than a licensed importer, licensed manufacturer, licensed dealer, or licensed collector) who the transferor knows or has reasonable cause to believe does not reside in (or if the person is a corporation or other business entity, does not maintain a place of business in) the State in which the transferor resides; except that this paragraph shall not apply to
    (A) the transfer, transportation, or delivery of a firearm made to carry out a bequest of a firearm to, or an acquisition by intestate succession of a firearm by, a person who is permitted to acquire or possess a firearm under the laws of the State of his residence, and

    (B) the loan or rental of a firearm to any person for temporary use for lawful sporting purposes


    As far as people that go to a gunshow across a state line, and buy from private sellers there, it is a GREAT way to get a felony conviction, lose your right to own ANY gun, and spend the next 5 years with roommates you did not pick.

    Red flags on any sale- money order, too much money, will use WESTERN UNION. Avoids that pesky "using the US Mail to defraud" thingy.
