I just finished filling out my C&R renewal and was surprised to see question #8 ask my if I have, or planned to do any internet sales. It then went on to ask which site(s) I planned to use. I don't remember that last time, any idea as to when that appeared?

I noticed that question when I filled out my application for renewal. I don't remember seeing it before. Wasn't sure if it was in reference to a business website you built or one you used often. I put down GB and AA(or GA now) websites.

No, but they have always had at least one inappropriate question on the C&R application form. The C&R license is to be used only when acquiring a C&R firearm, so a question about sales was obviously intended to apply to 01 dealers, not C&R licensees.

EDIT: A C&R licensee can dispose of a C&R firearm in interstate commerce only if the buyer is also a C&R licensee (that is the same privilege that a non-licensee has). See ATF P5300.11 page 51.

I concur with rufe-snow; see the same page. Anyone using a C&R as a cover for being the business of buying & selling firearms risks federal felony charges.

Why would it not apply to C&R holders? You can legally buy and sell on GB with a C&R license if it fits in the use of the license....

A lot of Shuck and Jivers try to take advantage, of less knowledgeable folks. By passing off a 03, C & R license, being the same as a 01, Firearms dealers license.

These kind of trick questions IMHO. Give the feds leverage, if they want to go after you for selling. Multiple C & R's on the auctions. Over and above what a collector, would normally expect to sell.

That question was added in 2014. I spotted it when I renewed my Type 01 FFL last week. If you hold a C&R and don't plan to use the internet to sell any of your personal firearms then you can truthfully answer NO. If you do have any such plan then by all means use Gun Broker for the sales!

I would just answer "NO". ATF watches for people who are planning to use their C&R to buy and sell on a regular basis, which is prohibited.

NO one can hold anyone accountable for what he MAY do in the future planned or unplanned. How ever if the question was Have you ever sold
or purchased a C&R on the internet you better answer YES if you did so or may have done so but forgotten for sure.

I am working under the impression that a Type 3 C&R allows me to PURCHASE all I want from the weapons that fall within the C&R parameters.

It's the SELLING that could be problematic if "overdone".

Actually you can buy and sell, but for enhancement of the collection. If you have a model 42 and find one in higher condition you can buy it and sell the original. You can even make a profit. You can also decide you don't want to collect Colt Woodsman any more, but want to focus on Colt SSAs, and you can sell the Woodsman. What you cannot do is constantly turn the "collection" over, buying and selling pretty constantly.
