My father is moving back to upstate NY (way upstate). He owns several pistols and rifles that take standard capacity magazines.
What are his options with these? One is a keltec su16. Can he just get 10rd mags for it and get rid of the 30rd mags? Also same with other rifles?
His daily ccw here in PA has been a sccy 9mm. It only comes with the 10rd mag I believe. Is 10rds legal in new york or is it 7rds?
Can he transfer his pa ccw or does he have to surrender any handguns untill he gets a NY permit? If he can even get a NY permit.

Best to Google the nys safe act.
When it comes to pistol permits, the northern and western counties are pretty good.Most want a 6 month residents and local references, best to leave pistols behind and ship them later.

NY State is a "may issue" state, meaning it's up to the local judge if someone is granted a permit. Upstaters have a better chance of being approved than downstaters as they have more conservative judges. In fact, many upstate Sheriffs have refused to enforce the "UnSAFE Act".
Your dad can take his long guns into the state but any pistols need to be shipped by his local FFL dealer to an Upstate NY FFL to be held until he (hopefully) gets a handgun permit. Permits from other states are not transferable into NY State as the state does not recognize any permits other than their own. He can expect to jump through a lot of hoops to get his permit and the waiting period for approval can be six months or more. He needs to establish why he needs a handgun permit and "self defense" is not a legitimate reason! In some counties, a judge will grant a "conditional permit", allowing a person to only possess a handgun at home, at a state-recognized shooting range, or possibly hunting at the judge's discretion. Personal protection permits are extremely difficult to get. I've had my NY State Personal Protection permit since 1977 and it was a pain in the butt to get it even back then: I needed six personal character references, a letter from my employer stating that he was aware and approves of me obtaining a permit, a physical exam report from my doctor stating that I was both physically and mentally capable of possessing a permit, a personal interview with the issuing judge (who tried to "race bait" me to see if I had any racial prejudices), and then waited six months to find out if I was approved.
If your dad's application is approved, he will first need to get a receipt from the dealer who is holding his handguns showing make, model, caliber and serial number. He then needs to go to the local permit office (usually the Sheriff) and get "purchase coupons" for each of his guns. The permit office will enter the guns on his permit and give him the coupons. He can then go back to the dealer, give him the coupons, and get his guns.
10-round magazines are legal but can only be loaded with 7 rounds except at state-recognized shooting ranges. Simple possession of any magazines capable of holding more than 10 rounds is a crime and subject to arrest and confiscation of ALL of his firearms.

I have no idea why my parents are moving back to that state. But pretty much nothing they do anymore seems to have any thought behind it.[V]. I will let him know that.
What can he do with his pistols and revolvers if he is denied the permit? Local ffl has to sell them? Could they be transferred here to me in PA?0 -

He would have a few options: As the FFL dealer has possession, that dealer can ship them anywhere that's legal, including your FFL. You would have to complete a 4473 and pass the background check, of course. Or, the dealer could sell them on your dad's behalf. Finally, he could put them on someone else's NY State permit but that person would need to keep possession of them.
My suggestion is that he stay as far away from NY State as possible!0 -
Wait till you get to working on a Will or Trust in New York State regard your gun collection. Superintendent State Police administers and rank and file carries out Safe Act. When it gets too deep for them call your lawyer and if he is smart enough to get a piece here and there from penal code and Safe Act maybe he can make you happy! 15 days to S--T or get off the pot. Immediate family exempt! LOL dream on. Best thing, get your damn guns out of New York State. You think they are your personal property to pass on? Not after 15 days and one year in limbo. Your Trustee or Executor could be committing a felony. People are actually setting up Gun Trust. 0 -
If your Dad doesn?t already have a NY state handgun permit issued in a NY state county, then he can?t bring his handguns into the state.
If he lives down state & already has a permit, he only needs to go to the Sheriff department of his new county of residence, and have his address changed on his permit.
That being said, each county Judge who issues the permits is different and some may require him to go back through the dog & pony show of resubmitting a request for a new permit.
The best thing he can do for himself is to contact the Sheriff?s department were he will be moving to, and ask to speak to their office that handles licenses for handguns, & ask them directly.
Where exactly is he moving to? I also live way upstate, about as far North as you can & still not have to speak French...[;)]

Don't forget if you already had a New York Permit it had to have been re-certified. Also, County Clerks administer permit system and are very helpful, not to say that Sheriffs Office doesn't get involved. You could not re-certify if a resident of Pa. 0 -
Heck, if he's _got_ to move to NY, he should probably sell/ privately transfer them to you before he goes.

In 1989 on trip across North America asked gun dealer in Tok, Alaska what I had to do to get a permit. He replied " Son you must be from the Lower 48, we are still FREE up here." Gives me goosebumps to this day. The word Infringement comes to mind. 0 -

Depends on the county, up here in Washington County on the Vermont border, and very few folks...my wife got her permit application in the first week of this past September...she took the mandatory safety class offered by the Sheriff's Dept. two week later...in mid October she was called in for finger printing. She was issued her permit the second week of November.

No County Clerk has any dealings with issuing permits in my county. It is all done at the Sheriff's Department.
In the County were I live (Jefferson) you have to obtain a permit packet from the Sheriff's department. When you turn it in you must pay around $120 for processing.
You must take an approved firearms safety course, and have four background references sign a notarized document claiming they have known you & for how long. Once the Sheriff's Investigators have completed their background investigation the permit request is giving to the county Judge to sign.
Then they will require the four who vouched for you to resign documentation stating they know you. Then they will call you to come have your picture fingerprints taken. You also have to pay for your fingerprinting.
Once all this is done they will put whatever handgun you need a permit for on the permit, and issue it to you. The permit has to now be recertified every five years.
My wife just went through this. It took her 17 months to receive her permit.
