In almost all states that collect sales (or use) tax, the retailer is the entity responsible for paying the appropriate sales tax. In order to do this, we collect the tax amount from the customer at point of sale, and then we pay the tax due to the state agency either quarterly or yearly: it normally depends on how much business the retailer does.

If tax is not collected, but sales tax is due, such as a CA resident buying an item in Oregon, it is the buyers obligation to pay up. In some cases this can be done through a line on a state income tax form. In cases where there is no state income tax, the buyer can usually download a form from the sales tax agency in his home, fill it out and then mail in the form along with the unpaid tax. As always, individual states have their own rules.

One more thing. Members who choose to respond will focus directly on the question. I don't want another series of rambling posts on the un-constitutionally/illegality of sales taxes. That has been done to death.
