this is a common problem with the m-70, any wear to any of the trigger/safety parts/pins and you get this. you need to'adjust' the sear/striker interface so that the striker 'sits' slightly forward and is moved back when the safety is engaged.

In answer to your questions: ANY IDEA'S?

I like Winchester 70's also and as Mike says it's a common dangerous issue with the Model 70's with the 3 position safety.

I suspect what you mention is why several of the used Win 70 rifles are placed on the market after the owner got a estimate for repairs due to NLA obsolete parts and the proper fitting of parts required for proper safety. AND it's not just a post 64 Model 70 issue as some try to claim. It can crop up on any of the Win 70 rifles.

Brownells, Gunsmith Kinks III (3) on page 303-306 has an article about Win 70's safety's, how to check and some of the requirements for fitment of parts . Briefly mentioned is: The safety lever when in center position should retract the sear engagement a Min of .010.

I have repaired several of the Winchester 70's for myself and my son (not for others) that had the safety issue YOU MENTION and is one of the first things we check before using a Winchester 70 with the 3 position safety.

AND just replacing parts with new will not usually fix the issue. The trigger, sear, firing pin, and safety lever, parts have to be fitted by a competent gunsmith, not some so called gunsmith that only has a dremel tool and a flat bastard file.

This correct FITTAMENT of parts is why Winchester and several other gun manu's only sell these type parts to authorized gunsmiths.

I've seen instances where people try to fix such by just adjusting the trigger pull and overtravel and these adjustments of the trigger does not correct such.

Also Winchester 70 parts now days are expensive if found and some advertised as New Old stock are old worn out parts.

You can review the price of some parts for a Win 70 rifle at this link just to get an idea.

I think MAYBE this company advertises that they will do a fitment of their parts into a Winchester 70, but not sure. I have had no dealing with this company, I just use their on-line diagrams and parts info, etc, for my own info and use.

    Winchester Model 70 Parts (midwestgunworks.com)

That is a very dangerous gun and needs to be repaired by a competent gunsmith.

It's a mechanical device and ALWAYS keep the barrel pointed in a safe direction. (on any gun)

See that your friend is made well aware of his unsafe gun.

thanks all. you confirmed what i thought i knew about how it operates. when i move the safety from fire to safe i do not see that .010 reward movement of the striker. when i have it on safe, and pull the trigger, i do see the striker drop slightly. the problem seems to b that the seer at that point is no longer engaging the striker. way beyond my level of expertise.
