Seller will not refund payment for lost shipment Winchester 94 rifle
Auction closed 07/31 - FFL received by seller 08/03 - Payment certified check received by seller 08/05 - Seller ships rifle 08/12 - Reported to seller shipment lost 08/19
Seller begins tracking rifle with UPS on 08/21. Seller refuses to refund payment from 08/05 until a claim is paid by UPS?
Today is 2 months since auction close.

yes, have tracked and reported to seller since 08/19 - have contacted UPS as 3rd party and attempted claim - UPS says says claim initiated from seller already. Seller continues to report UPS is attempting to locate. 0 -

You can call the States Attorney General and relay the situation to put pressure on the Seller. (One suggestion.) If USPS get a Postal Inspector involved. UPS/FED EX, start working your way up the Ladder. (*Missed your third post while typing this one.)
*Another great reason to use a CC. More protection built in, including a Charge Back.

You're in a bad spot between the seller and the shipper. Was the package insured for the full amount of the purchase price when shipped? If so, then there is no doubt that you should be refunded your money. Info about UPS being responsible for lost packages that were uninsured is hit and miss.. The seller has most likely spent the money, and doesn't have it to refund. Sounds like the seller has started a claim, which is good, and their responsibility. Good Luck... 0 -

It sounds like UPS is stalling, trying to find the package before they have to pay the claim. Probably not much either one of you can do. You should be able to go online and follow the claim though.. 3 -
If UPS is confirming full amount insured through them to Seller, I'd be on the phone leaning on him big time, after the length of time you have indicated. You have been more than patient Sir.
*Any idea how long UPS gives it before reimbursing Shipper?

Seller continues to report UPS is attempting to locate. ... That is screwed up... no doubt a tracking number.. However... they just busted a UPS hub here in Columbia SC for stealing firearms. 0 -
The seller is obligated to deliver what you paid for as the buyer. You never got the item, he owes a refund to you and can haggle with the shipping company over insurance. Until the transaction is complete it ain't over. UPS looking for it does not let him off the hook for a refund in my way of thinking. If they find it and ship it to the FFL you can resend the money and all is good. As it stands you paid for an item you never received. Hound the seller for a refund. 6 -
