    True - in WV it’s up to the FFL’s discretion.  I will waive the check for people that I know and trust.  However, strangers don’t get that option.

    I Bet if the law was written on the side of freedom (allowing purchases if system down) then the system would never actually go down.

    It doesn't surprise me.  With the volume of gun purchases someone like decided to put the squash on things.  Last Friday I picked up a Stribog.  Typically I comeback nearly instantly, usually with in a couple minutes, this time it took about 30 minutes, while many others were being delayed.  My buddies son has been delayed indefinitely with a message to the FFL that his is in "research".

    You are mistaken.  The notification was just to let everyone no there won't be a "further review" if on phone or "researching" if on LEEP.  It is a simple go or no go.  Either "proceed" on the spot or "Delay", with almost all of the ones that go to researching for 30 minutes and then ending up as a delay I actually prefer this, now I won't have the customer impatiently waiting for half an hour only to then be told he got put on a delay.

    Good Afternoon,

    As a result of the increased workload and modified staffing schedules due to the COVID-19 protocols, beginning at 12:01 am ET, Saturday March 27, 2020 until 8 am ET, Monday March 30, 2020 the NICS Section will be temporarily disabling the Transfer Process. This means, when calling in a NICS check, you will be given a status immediately, to include delays with a Brady Transfer Date, and not transferred to an FBI Examiner for further review.

     

    If you have any questions please to not respond to this email, instead please email nicsliaison@fbi.gov.

    Shilo, My check went thru in minutes yesterday. I didn't see the dealer on the phone so I guess he either emailed or faxed it from his PC, surprising.

      the right to bear arms is really  "the right to ask to have a back ground check done and get or be denied a right " and even  that is being held up to slow or stop gun sales

    Has absolutely nothing to do with “friends.” Has everything to do with knowing and trusting someone to be law abiding.

    Bought a Ruger PCC 9 carbine for myself. Also sent one to my sister in MI. My BGC went from researching to delayed. That was 4 days ago.

    Called the shop in Arkansas yesterday, owner said he'd call me back if it was approved yesterday. No call. He said I can pick it up Monday.

    I figure, I'll have him make a copy of my MO CCW for his records.

    NICS is running normally so far, haven't had an instant "delay" yet but the "proceeds" happened normally.

    Soooo, since the federal government does not give you the go-ahead, you feel they are not approved and even though state law says the CCP background check serves as a purchase background check...you choose to deny a person their rights?

    I wish you would re-think this.  The commies are taking our rights so rapidly that we certainly don't need to give any away.

    If you are worried about getting sued/prosecuted,
    I would be more worried about someone suing me for not following the law (and they were injured/killed because they were denied legal access to a firearm) than getting prosecuted for following the law and selling a gun to someone who forged a handgun permit to "legally" purchase a firearm.

    The same applies to the 3-day-no-response from ATF.  The law says the dealer can complete the transaction.  I have been denied twice on this little technicality.

    I'm not trying to give you a hard time just for the sake of being argumentative, but I hope you, as well as other dealers on this board, will consider this situation.

    At our store we take CWP in place of running a Nics check but are sort of selective about the transfer if no response (Brady Transfer Date). We have had bad experiences with it and creates a no win situation when we transfer the gun and it comes back a week later denied.

    Try retrieving a gun that went out with a buyer denied a few days later.  Most FFLs I know will not release a gun until they get a proceed.  Period.  Mine won't.  I get a delay about 25% of the time.  He knows I have always gotten a proceed after 1-3 days in over 40 transactions.  Still, he does not release it until he has a clear proceed.  I don't blame him at all.

    This has happened more than once to us. We release the gun after the Brady transfer date. A week or two later NICS calls back giving a deny. We have to call customer and tell him he has to bring gun back or authorities will come get it. Customer is pissed off...at us. Customer returns gun,that he took out shooting a few times, we give him what we would pay for a used gun, somewhere in the ballpark of $75-125 less than what he paid for a couple weeks ago, customer is now really pissed.


    See, no win situation. In about 1/3 of the cases we know the guy, or it's not really our gun(transfer, raffle, etc) we will transfer it and give them the spiel about if it comes back later as a deny they can expect to have to return it immediately or have law enforcement knocking on their door.

    DHS has designated firearms retailers and their workers as essential.   I had another FFL dispute the OP and said NICS worked fine yesterday.

    shilowar , Correct, Nics worked fine. If you read through the comments I posted the letter and explained what it meant. The only difference was those FFLs that still phone in NICS checks no longer get a further review. It's either an instant "proceed" or "delay".

    Here in TN, (which is usually "Gun friendly,") they are not even interested or swayed one bit on your producing your CCW card. Pretty useless in trying to receive a Firearm. It makes no sense to me. You would think after all the hoops you have to jump through in order to aquire one, it would make a difference. Nope.

    Doesn't matter here in VA either, but my check usually comes back super fast so I don't know
     if the CHL helps speed things up or not.

    A few days ago we got a delay reply on someone's background check.    The date they gave us for transfer was two weeks out...not three business days, so I was super confused by that when it happened.     I checked on it a day later and the guy got a proceed.    So, I think they are putting these messages out to let everyone know it COULD be a very long delay before things get approved.     Its just adding fuel to the fire in my opinion.     They should have just released a blanket message about state offices being closed and it potentially leading to long delays in transfers instead of this mess they are doing......releasing daily updates is just making everyone aggravated.

    When I was an FFL in Virginia I had a customer with a CHL and also in the financial sector (with a much stringent BGC) that always came back delayed.  It got to the point that he’d Just fill out the paperwork and leave.  I’d call when the approval came back.
