If a widow dies with no will and has two living married sons will the sons each get 50% of the estate?

    Just like gun laws, state laws are all over the place on dying intestate (without a will). For property to transfer after death, it usually must go through probate, which includes settling debts owed by the estate. If we're talking about estates valued at under $100K, this is usually straightforward. When you start getting into serious money, it can get complicated; especially when "long lost" relatives suddenly come forth to claim a piece of the prize.  Don't die without a will.

    You also at times have to fight "States" in estate settlements......Florida at one time (not sure about the present) had huge estate taxes if one died while living in Florida (especially retirees), my Grandfather was born & raised on our family farm, when he retired he to satisfy my Grandmother (a Florida native) moved to Florida and he started raising cattle on a small property out of boredom, he passed away down there and the State of Florida did their best for several years to claim him  as a resident  :). He'd already signed the farm over to Dad so there was no possibility of them chasing dirt but he did have a sizeable cash stash, stocks & bonds stored banked away which was gotten out of Florida ASAP after death. He was smart enough that when he purchased a vehicle he purchased it in Georgia, titled & tagged in Georgia, kept his Georgia drivers license current, voted in Georgia, paid Georgia income taxes, buried in Georgia etc. etc. all of which was our saving grace in the different courts. As smart as he was with money a simple $100 lawyer (estimated) could have save years of travel and legal expenses on us to prove he was 100% Georgian. I learned a lot from this so please people......get a damn will prepared, it''s simple.

    No probate if both parties agree to terms and estate is small.

    In some state person passes with no will, next of kin gets the estate, and that might not be the wife.
