If it's the same incident I'm thinking of - from a few months ago - it did not happen that way. In that one, there was one missing glass panel on the observation deck, and the child picked that space to lean against. Grampa watched in horror. The negligence was on the part of the crew for not taping off or blocking the open space.

from last I heard Grandpa was leaning out of the open window and knew it was open the cruse ship suppose to have at least two security cameras with footage of it
I would wager a ambulance chasing lawyer or two got involved
