Buyer received firearm but has not submitted payment

    Looking for solutions. Buyer managed to receive the firearm before actually submitting payment - the checkout system then auto-completed and I haven't been paid yet. This occurred all the way back in October, 2020. Gunbroker's customer service/support has been completely useless in the meantime. Any ideas?

    How did he manage to receive the gun before paying for it? If you shipped prior to payment, then that was a mistake on your part. If the buyer accepted the gun and refuses to pay for, it is now a case of theft. This is a criminal matter to be handled by the police and not Gun Broker Customer Service, who the last I heard, lack police powers.

    You never should have shipped it without the pesos in hand.

    Give the customer service folks time. They're overwhelmed right now.

    Contact the local police agency where the firearm was shipped and report it stolen. Give them the FFLs name and address so they can get all of the non paying buyers information from the 4473 form. It seems you were either way to trusting or shipped early by accident. Good luck getting this straightened out. Bob

    BobJudy, as always, gives sound advice.

    On a personal note; I have shipped ahead of payment to forum members, as well as buyers who I have dealt with before. Failing that, I want to have the cash in hand before shipping a gun. No buyer will consider a sellers' policy of payment before shipping as being unreasonable, so there is no valid reason not to be paid first.

    I am glad that this post was not closed. The information presented is important, and educational.Rules do not always cover common practices and proceedures. Thank you to the moderators for letting this thread continue.

    It's continuing because the OP, despite his having posted his crisis in three different sub forums, hasn't bothered to reposed. What he has to say, and more importantly, how he says it, will determine how long the thread remains.

    One thing that I learned is when you report the gun stolen....because it is a sale between you and the buyer it is not the same as them "stealing" the gun....it is a business transaction that has not been completed between the two participants. So, you cannot file criminal charges...but you can sue them in small claims court.

    call the local police and the FFL to get the info if they will give it to you .

    but I truly think you just gave away a gun , hope you did not loose too much

    Since you voluntarily shipped the gun, I think the police are likely to tell you it's a civil matter.

    You have a paper trail of the firearm. IF the buyer is not communicating you have a problem. Most court filings can be done online for small claims. You most likely if you want a recovery are going to have to use a small claims court.
