Judge tosses suit over Pop-Tarts fruit exaggeration claim
A federal judge in Manhattan has dismissed a proposed class-action lawsuit accusing Kellogg of using misleading labeling to exaggerate the amount of strawberries in its Pop-Tarts.
Basically the judge said if you buy a frosting covered toaster pastry then you shouldn't be stupid enough to expect real fruit and any nutrition. There are still a few judges out there with some common sense. Now if those disappointed lawyers that had visions of dollar signs would just wise up, the world would be a better place. I am surprised that the makers of the Mars candy bars haven't been sued because they don't come from the planet Mars. Or that KitKats don't contain any feline ingredients. Bob

Frivolous, to say the least. When someone files such a lawsuit, they should be charged for the lost time spent by the court system to prepare the case.

I eat Pop Tarts on occasion, I wasn't expecting to be Superman after consumption and I didn't care if there was any strawberries in them cause I eat the cherry ones.😮
