    It's all over the internet I don't know how to post a link on my phone but it's easy to find .

    Most states would it be obvious self defense but NY will none of that they can't have law abiding citizen harming ther protected class

    Charging him for killing the guy is total crap

    I Hope it gets kicked out oon too bad he can't sue the paints off NY for charging him

    The "Joke," (although NOT Funny) when I lived up there, was that if you shot someone breaking in to your house, you would probably do more Jail time than the Perp.

    How screwed up is that?

    Once the attendant disarmed the guy and had his gun threat was minimal if at all.

    To then go ahead and shoot him is attempted murder.

    Had the attendant had a gun of his own and used it, it would probably been self defense.

    I could (possibly) understand a charge of Attempted Negligent Homicide up there in La La Land, (But) Attempted Murder is a HUGE stretch. IMHO. It's not like the guy planned it, or the struggle over the weapon (after having been shot.) He defended himself and in the struggle, the guy who shot him was shot with his own weapon.

    I'm pretty sure it is DA Bragg. (Hmmnn..........................where do we know that name from?) The general Public will rally around this guy (a Blue Collar worker) and due to "Public Outrage," he (Bragg) will drop this case also.

    He (Bragg) seems all about pandering to the Voters, in order to garner re-election.

    He is also a big proponent of the "Catch and Release," currently taking place up there. How's THAT working out for everyone?

    I'm going to have to disagree with that. Unless the attacker is lying face down with arms spread or running away the fight is still on. He already showed he is willing to kill over a minor issue and you don't know what else he has. He might have decided to never go to (or back to) jail and is waiting for the victim to be distracted to attack again, Might have a knife or another pistol. Might be a MMA fighter.

    Both have nothing to worry about. bragg will make it a misdemeanor and both will walk after paying a $25.00 fine.

    Beat me to it. Did not read this until this am. If the struggle is still on and the perp is actively trying to take the gun back and has already shot you once, you know if he gets the gun back, he has no problem shooting you again.


    Glad the charges have been dropped. 👍

    If some one shoots you and you return the favor, even with the assailants own gun, it is not attempted murder, it is a COMMON SENSE response to being attacked. The attacker just might disarm the guy he shot and shoot him again. The best way to stop that from happening is to take the gun and bust the guy in the chest. The issue I see is he forgot the golden rule, two in the chest one in the head.

    Wow, really?

    The attendant was shot in the stomach and grazed in the ear by a bullet. That perp was trying to kill him. The attendant was severely wounded, according to reports, and was defending his own life. Doesn't matter if the perp had his gun removed, may have a 2nd gun, knife, hammer, anything and being shot already the attendant was very limited in defending himself.

    No, no,no. I guess I wasn't clear enough. My reply was to the OP, as why they would charge him,what their reasons would be given the location, and DA, and being this "same Da a year ago..."

    We later learned more details of the incident, and learned charges were already dropped. I replied to that with, surprised but glad. Surprised, given the location and DA that they dropped the charges and so quickly. Glad, they did.
