Selling Class 3
A good friend of mine passed recently and we had talked abut selling his collection. He has a few class 3 items and I'm not clear on their sale. I sold mine a few years ago to a TN dealer and had to apply for fed permits to take the out of state. That worked out well but this is somewhat different. Can the exectuter of his estate take legal possession without a formal transfer and the $200. 00 stamp and months of delay? Though the will hasn't been read yet, I'm too old to go to jail if they are left to me to sell!

I hate to say it but you may have ask the ATF as a lot resort I can guess their answer just give them to us
Id me i would find a class 3 dealer in my area and work out a plan I would start asap
My youngest son held a class 3 ffl several years ago but I think after he sold off his ammo eating toys
he went back to just a normal ffl

The heir to them can do a form 5 for a tax free transfer. From there a form 4 will have to be done on any subsequent transfers.
Form 5 - Application for Tax Exempt Transfer and Registration of Firearm (ATF Form 5320.5) | Bureau of Alcohol, Tobacco, Firearms and Explosives
This form is used to apply the tax-exempt transfer of an unserviceable (welded) firearm to anyone other than a federal firearms licensee who has paid the required special (occupational) tax to deal in National Firearms Act (NFA) firearms and to or from government agencies.
Just take the info DIRECTLY AND EXACTLY off of the form 4, put the heirs name and address in the transferee box and follow the other instructions at the bottom. Form 5s are also expedited but I don't know the time frame on them as it's not something we deal with, form 5s are between the individuals and the NFA branch.

Do not ask atf. Take to a SOT dealer near you to sort out

Have the class 3 dealer come to you do not transport luck would have it traffic stop and a nosey cop

If the person put it in an nfa trust it is almost easier as the other responsible parties listed in the trust can do as they please with it.
