Clarifying GunBroker Policy on Final rule 2121R-08F – Factoring Criteria for Firearms with attached “Stabilizing Braces.”

As stated in the New ATF Stabilizing Brace Rule article, the ATF’s new “Stabilizing Braces” rule for pistols went into effect on January 31, 2023.
While GunBroker.com actively monitors and removes all noncompliant firearms, we acknowledge the practical challenge of updating the thousands of listings affected by this change which prohibits “stabilizing braces” from being mentioned, shown, or included in the sale and listing of any firearm not categorized as an SBR. To assist sellers in updating listings to comply as easily as possible, GunBroker.com has developed these new guidelines for listing (and relisting) pistols:
If a pistol listing or relisting meets one or more of the following criteria it must be categorized as a Short Barrel Rifle (SBR) under the Class 3 Firearms, NFA & Destructive Devices / Short Barrel Rifles (SBR) Category:
- The listing’s text or code mentions a brace for any reason including (but not limited to) phrases like: accepts brace, brace-ready/compatible/adaptable, no brace, brace sold separately, brace not included. Synonyms, slang, alternate spellings, and other variations are equally prohibited.
- Any part of a brace is visible in any of the listing’s images (further guidance below).
- A brace is otherwise implied or included in the sale for any reason.
GunBroker.com reserves the exclusive right to determine compliance with the terms above.
For items newly prohibited by this rule, braces may still be sold separately when removed from the firearm and listed as a standalone accessory in the appropriate category: Gun Parts > Pistol Parts > Other Pistol Accessories & Parts.
Similarly, firearms updated to no longer include a brace may be relisted so long as all mentions and images of any part of the brace are removed from the listing’s text, code, and photos. For the easiest photo fix that temporarily extends the time needed to retake pictures, GunBroker.com will allow sellers to edit existing pictures to fully hide the brace and display “NO BRACE INCLUDED” in clearly visible, bold letters in its place until May 31, 2023, as described below:
The image below of a non-SBR categorized pistol with a brace that was previously legal before January 31, 2023 has been properly updated to comply with rule 2121R-08F but will need to be removed and retaken without the brace if used in a non-SBR listing after May 31, 2023:
The image below is prohibited indefinitely since part of the brace is still shown:
This image of a pistol with the brace removed and no text will not need to be updated to retain its categorization as a pistol so long as a brace is not mentioned anywhere in the listing:
After May 31, 2023, photos which display the word “brace” or variations thereof will be considered part of the listing text and subject to the same grounds for removal, so please retake and replace or remove these images by this time to avoid further disruption.
