On Monday, January 30, 2023, the Bureau of Alcohol, Tobacco, Firearms, and Explosives published the final Factoring Criteria for Firearms with Attached “Stabilizing Braces” rule for public inspection in the federal register. This rule went into effect and enforcement by the ATF on January 31, 2023.
In compliance with the rule, GunBroker.com actively monitors and removes all pistols pictured with or mentioning attached stabilizing braces which are not listed as a Short Barrel Rifle (SBR) under the appropriate Class 3 Firearms, NFA & Destructive Devices category as these are no longer legal after the effective date. Additionally, GunBroker.com will continue to monitor and remove all listings (and relistings) that do not comply.
To list or relist a pistol, one of the following criteria must be met:
- Any new or previously attached brace(s) must be completely removed from the item and fully excluded from all listing text and picture(s).
- The item must be listed as a Short Barrel Rifle (SBR) in the Class 3 Firearms, NFA & Destructive Devices / Short Barrel Rifles (SBR) Category.
